User Agreement, Registration, and Personal Data Protection:

By registering on Gaia Learning's FlexiSchool platform, you confirm that you meet the age requirements, and you agree to comply with these Terms and Conditions. These terms govern your access, use, and purchase of content from the platform.

As a registered user, you are granted a personal, non-commercial, non-transferable license to access and use the educational content available on the platform. Your registration involves creating a unique and exclusive password, which you may not share with or transfer to any other person. Any unauthorized use of your password should be reported to Gaia Learning immediately. We reserve the right to suspend or revoke your password in case of misuse or violation of these Terms and Conditions, in which case you won't be entitled to any refund or payment.

By using the platform, you accept that Gaia Learning reserves the right to change, suspend, or remove content and discontinue the platform at any time. You are also responsible for regularly reviewing these terms and agreeing to any modifications that may be made from time to time. Unauthorized use of automated systems to access the platform is strictly prohibited.

Age Requirements:

The registration and use of the FlexiSchool platform and the services offered therein are subject to the following age requirements:

• If you are a resident of India or any other country, except the United States of America (USA), the United Kingdom (UK), or European Union (EU) countries, you must be at least 18 years of age or have attained the age of majority as per the applicable laws of your country of residence.
• If you are a resident of any EU country, you must be at least 16 years of age.
• If you are a resident of the USA or UK, you must be at least 13 years of age.

For users who are residents of the USA, UK, or EU countries and are between the ages of 13 and 18, or 16 and 18 respectively, or for residents of other countries who have attained the age of use for internet services but are less than the contractual age determined by the applicable laws of such country, please note that your use of the platform must be with the explicit permission of your parent or legal guardian.

By using the platform, you confirm that your usage is with the permission of your parent or legal guardian, and that your parent or legal guardian has read, agreed, and accepted the terms of our agreement. In the event of any dispute arising from your agreement with us, the terms of our agreement will be applicable to and enforceable against your parent or legal guardian.

Please note that the FlexiSchool platform and its services are not directed at minors or children, and individuals who do not meet the above age requirements ("Minors" / "Children") are not eligible to register on and use the platform and/or services by themselves. For the purposes of these platform terms, "Minors" / "Children" are individuals who do not fulfill the above-mentioned age requirements, as may be revised as per applicable laws from time to time.

Gaia Learning reserves the right to terminate your Subscription and / or restrict your access to the Platform, if it is discovered that you do not meet the Age Requirements. You acknowledge that Gaia Learning does not have the responsibility to ensure that you conform to the aforesaid Age Requirements. It shall be your sole responsibility to ensure that the required qualifications are met, and continue to be met with, at the time of your registration on and/or use of the Platform.

User Obligations and Conduct:

All users of the FlexiSchool platform are expected to maintain a respectful and safe learning environment. Any form of inappropriate or abusive language, bullying, harassment, or other kinds of misconduct are strictly prohibited. Users are expected to treat all other users, including fellow students, parents, and teachers, with respect and courtesy. Behaviour that is deemed as violating these obligations will result in actions being taken, including, but not limited to, warnings, temporary or permanent suspensions, and/or involvement of appropriate law enforcement agencies, where necessary. Parents or guardians are expected to monitor their child’s activity on the platform to ensure appropriate usage and conduct.

User Generated Content:

Users are responsible for all content they generate and share on the FlexiSchool platform. This includes, but is not limited to, messages, comments, homework assignments, and discussions on the forum. Inappropriate or harmful content, including content that is offensive, harmful, abusive, defamatory, or violates someone’s privacy, will not be tolerated. Users are prohibited from sharing content that promotes any form of discrimination, hatred, violence, or illegal activities. We reserve the right to remove, without prior notice, any content that we believe violates these rules, and to take further action, including reporting to the relevant authorities, where necessary.

Moderation and Report Systems:

In order to maintain a safe learning environment, the FlexiSchool platform operates a system of content moderation. We have a dedicated team who monitor the platform and review any reported content or behaviour. If you come across content or behaviour that you believe violates our Terms and Conditions, you can report this to us directly through the platform’s reporting function. We take all reports seriously and will investigate them promptly. Any user found to be in breach of our Terms and Conditions as a result of such reports may face actions including, but not limited to, warnings, suspensions, permanent account deletion, and where necessary, reporting to the relevant authorities.

Account Security:

We place great importance on the security of all user accounts on the FlexiSchool platform. Therefore, you are expected to take responsibility for the security of your account. 

Keep your account credentials private: You must not share your account details, particularly your password, with anyone. You are responsible for all activities that occur under your account, even if they are carried out by others. 

Use strong passwords: To protect your account, we recommend you to use strong passwords. A strong password includes a mix of letters, numbers, and special characters. It is also advisable to change your password regularly. 

Monitor account activity: Regularly review the activities on your account. If you notice any suspicious activities, such as unfamiliar courses being accessed, changes in your personal details, or unrecognized devices accessing your account, immediately change your password and report the issue to us. 

Protect your computer and mobile devices: Keep your computer and mobile devices secure. Use up-to-date antivirus software, install the latest updates for your operating system and browser, and avoid installing software from untrusted sources. 

Remember, Gaia Learning will never ask you for your password in any communication (e.g., emails, phone calls, or direct messages).

Breaching these security rules may result in the temporary or permanent suspension of your account. In the event of any dispute or legal proceedings, you will be responsible for the activities that occur under your account.

Disclaimer, Limitation of Liability, and Indemnity:

By accessing and using the FlexiSchool platform, you agree to these Terms and Conditions. If you disagree with any part of these Terms and Conditions, you should refrain from using our platform. Gaia Learning reserves the right to modify these terms at any time, and your use of the platform following any modification will constitute your acceptance of the changes. 

Upon registration, Gaia Learning grants you a non-exclusive, non-transferable, personal license to access and use the educational content available on the FlexiSchool platform. This content is for personal, non-commercial use only. You agree not to use automated systems, such as "robots," "spiders," or "offline readers," to access the platform. 

Gaia Learning does not guarantee uninterrupted or error-free access to the platform or its content. We will not be liable for any delay, interruption, transmission error, or failure of performance. While we will use reasonable efforts to correct any failure, we are not obligated to alter any equipment or software used by us, our contractors, or agents to ensure compatibility with your devices.

Gaia Learning reserves the right to change, suspend, or remove any content on the platform at any time and for any reason. We also reserve the right to discontinue the platform either temporarily or permanently. In such cases, you will not be entitled to any refund or compensation. 

Your use of the FlexiSchool platform is at your sole risk. Gaia Learning, to the fullest extent permitted by law, disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We make no warranties that the platform will be error-free or that any errors will be corrected, nor that the platform or the server from which it is operated will be free of viruses or other harmful codes.

Gaia Learning will not be held liable for any direct, indirect, incidental, special or consequential damages and expenses of any kind (including without limitation, personal injury, property damage, lost profits, business interruption, lost data, unauthorized access to site servers or any personal information stored therein, or any interruption or cessation of operation of the site) arising out of or connected with your use of the FlexiSchool platform. This limitation of liability applies even if Gaia Learning has been advised of the possibility of such damages.

You agree to indemnify, defend and hold harmless Gaia Learning from and against any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees and court costs) resulting from your violation of these Terms and Conditions or your use of the FlexiSchool platform.

Any cause of action arising out of or related to the use of the platform must be commenced within one (1) year after the cause of action accrues, otherwise it is permanently barred.

These Terms and Conditions constitute the entire agreement between you and Gaia Learning regarding the use of the FlexiSchool platform. If any provision of these terms is deemed invalid by a court of competent jurisdiction, the remaining provisions will remain in effect. Any failure by Gaia Learning to assert any right or provision under these terms does not constitute a waiver of such right or provision.

Updates to Terms and Conditions:

Gaia Learning reserves the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the FlexiSchool platform or the Service following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

We will endeavour to notify users of any significant changes to the Terms and Conditions by sending an email to the address associated with your account, or through a notification on the platform. However, it remains your responsibility to review the Terms and Conditions periodically. If at any point you do not agree with the current Terms and Conditions, you should cease using the FlexiSchool platform immediately.
